Mr. Vick called the April Board of Commissioners meeting of WCUD to order at 10:00 a.m. at the district office 3625 Lindsey Mill Road, Gatlinburg.

Motion to approve agenda made by Mr. Ball seconded by Mr. Conner and passed.

Motion to approve March 2009 Board of Commissioners meeting, March 13, 2009 Special Meeting minutes and February 2009 financial report made by Mr. Ball, seconded by Mr. Conner and passed.

Mr. Seagle of Outdoor Resorts of America requested the March 2009 flow meter reports for ORA. Mr. Sunstein stated he will get a copy provided to Mr. Seagle. Mr. Seagle questioned if ORA would be involved in the meetings with Raftelis Financial Consultants, Inc.? Mr. Vick stated the rate study is being done independently of the district and is being preformed for all district customers not just the complainants. The information will be made available at the district meetings which are open to the public. Mr. McGill stated if there is a need for any special meetings during the course of the study they will be open to the public and a legal notice will be published 48 hours prior to the meeting as required by the State of Tennessee.

Mr. McGill stated the district is still trying to help the people at Pinnacle View get water service. The estimated engineer cost has been cut as low as can be cut at this point.

Mr. Sunstein reported the water loss for the month of March 24%, 606,730 gallons. Two leaks were located and repaired.

Motion to approve the Fire Protection Service subject to changes made by Mr. Ball, seconded by Mr. Conner and passed. Copy of policy attached.

Motion to approve changes made to the District’s Emergency Plan made by Mr. Vick, seconded by Mr. Conner and passed. Copy on file in district office.

Mr. Vick and Mr. Jim Gass attended the Utility Management Review Board (UMRB) meeting held April 2, 2009 in Nashville, TN. Bent Creek Attorney Gary Logue submitted a written letter to the UMRB but was not present. Marshall Albritton, Attorney for ORA, Mr. & Mrs. Dean Lewis also of ORA were present. Mr. Vick stated there was a discussion on the implementation of cost of the study, the scope of the study and the selection process the district used to select Raftelis Financial Consultants, Inc. The district submitted a letter dated March 31, 2009 to the UMRB, copy attached. Mr. Vick gave Mr. Seagle a copy of the letter. The UMRB postponed any decision action regarding the complaint at the meeting. The district will submit a progress report to the UMRB for their June 2009 meeting, and the final study at the August 2009 meeting.

Mr. Conner had no official report.

Mr. Ball thanked Mr. Sunstein and Janice Carver for their work on policy changes, and the office renovations look great.
