Mr. Vick called the January Board of Commissioners meeting of WCUD to order at 10:57

a.m. at the district office 3625 Lindsey Mill Road, Gatlinburg.

Motion to approve agenda made by Mr. Ball seconded by Mr. Vick and passed.

Oath of Office was administered to Mr. Conner, by Ms. Carver.  Mr. Conner’s term to begin January 1,2010 – December 31,2013 as appointed by Mr. Larry Waters County Mayor.  Copy of Oath of Office attached, copy of appointment letter in district file.

Motion to approve December 2009 Board of Commissioners meeting minutes and November 2009 financial report made by Mr. Ball, seconded by Mr. Conner and passed.

Outdoor Resorts of America was not present.

Mr. Gary McGill was not present.

Mr. Jim Gass was not present

Mr. Sunstein reported the new metering manhole to be installed at Outdoor Resorts of America (ORA) has not been received.  Mr. Jim Gass, sent a letter to ORA the district will notify them before work will commence on the installation of the manhole.

Mr. Sunstein reported work is to commence on the bridge on Golf Creek Road January 12,2010.  Mr. Vick questioned if there had been a pre-construction meeting for the project?  Mr. Conner questioned how long the project will take for completion?  After a lengthy discussion it was decided that Mr. Vick would contact the engineer regarding the waterline that runs underneath the bridge.  The Board of Commissioners want a cast iron pipe installed in place of PVC.

Mr. Sunstein informed the Board of Commissioners that ORA sewer flow for December 2009 was 541,000.  According to the flow charts the rain appears to be affecting the flow.

Mr. Sunstein stated the district needs to make repairs to the district’s collection system in 2010.

Mr. Sunstein stated the district had 22% water loss for the month of December 2009, 529,694 gallons.  One leak was located and repaired.  The annual percentage of unaccounted for water is 17%  for 2009.

The first weekend in January 2010 the 300,000 gallon water storage tank overflowed.

The district obtained a state purchasing bid list, Ted Russell Ford Parkside Drive 2011 Ford F250 4X4, retail price $31,970.00, bid list price $22,100.00.  The districts 1992 Dodge truck needs to be replaced.

Motion to purchase the new truck as bid by Ted Russell Ford paying for it out of the money market account unless the district can obtain a 0% interest rate and to take sealed bids for the sale of the 1992 Dodge truck to be opened at the February 2010 meeting, delivery of the Dodge truck subject to delivery of the new Ford Truck, made by Mr. Ball, seconded by Mr. Conner and passed.

The district received the official Sanitary Survey with a grade of 100%

Mr. Sunstein presented job description for the new employee.  Mr. Conner has an application from Mr. Wayne Ball for employment.  After a lengthy discussion motion to recommend hiring Mr. Wayne Ball, starting pay of $15.00 per hour, 90 day probation period, as soon as he can begin made by Mr. Conner, seconded by Mr. Ball and passed.  Mr. Sunstein to interview Mr. Ball with Ms. Carver present at the interview.    Mr. Vick stated Mr. Ball seems to be a reliable person.

Ms. Carver stated the 2010 Budget was approved by the State of Tennessee Comptroller of the Treasury.  Notice has already been run in the local newspaper as required.

A response was received from Barnes Insurance Agency regarding fire hydrant liability.  “The policy does not provide any coverage for the lines and it cannot be added to the policy.  It is possible that is someone hooks to your hydrant and pulls too much pressure resulting in damage to your line that they would be responsible.  However, the responsibility of a third party is a legal question you would want to ask your attorney.”  This email is on file in the district office and was forwarded to Mr. Jim Gass.

Motion to approve commissioners or staff attend the TAUD Legislative Conference in Nashville made by Mr. Vick, seconded by Mr. Ball and passed.

Linda Morris’s attorney is working with the attorney for Bent Creek attorney working on reconciliation of the sewerline easement.

Mr. Vick had no official report.

Mr. Conner stated the district’s auditors are highly qualified he is very impressed with their firm.

Mr. Ball thanked the boys for fixing water leaks during this cold weather.

Under new business, Mr. Vick requested that Barnes Insurance Agency send a representative to the annually before the policy renewal to the Board of Commissioners meeting to give a review of coverage.

Motion to adjourn meeting by Mr. Ball, seconded by Mr. Conner and passed at 12:25 a.m.
