A RESOLUTION PROVIDING A PROCEDURE FOR MANAGING SEWER TAPS
THAT HAVE BEEN REQUESTED DURING THE SEWER TAP MORATORIUM
the
State of Tennessee Department of Environment and Conservation has
imposed a moratorium on additional sewer taps onto the Webb Creek
Utility District (District) sewer system for the past several years
and,
WHEREAS, the District has implemented the expansion of its
wastewater treatment plant capacity which will allow the lifting of
the sewer tap moratorium upon completion of the plant expansion,
scheduled to occur on or about April 24, 2004, and
WHEREAS, Exhibit A lists future sewer taps which have been
approved by the Tennessee Department of Environment and Conservation
with the sewer tap fees paid by the respective listed property
owners and with the District currently obligated to allow the
installation of these taps in accordance with the policies and
procedures of the District when requested to do so by such property
owners, and
WHEREAS, Exhibit B lists future sewer taps which have been
approved under the provisions of Resolution 1997-3 with the sewer
tap fees paid and monthly availability fees being paid by the
respective listed property owners and with the District currently
obligated to allow the installation of these taps in accordance with
the policies and procedures of the District when requested to do so
by such property owners, subject to the provisions of the Resolution
1997-3, and
WHEREAS, Exhibit C lists future sewer taps which have been
requested by the property owners as shown, however, neither tap fees
nor availability fees have been paid and the District is not under
any obligation to allow the installation of these taps.
WHEREAS, The future sewer taps contained in the respective
Exhibits are transferable with the property ownership with all
provisions of this resolution being applicable to the property
owner(s) on the dates contained herein.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF THE WEBB
CREEK UTILITY DISTRICT:
That the following
procedures will be managing the future sewer taps listed on Exhibits A, B
and C, respectively.
Exhibit A – A written notice will be provided by certified
letter to each property owner listed advising that the District must
receive a written confirmation of the reservation of their taps no
later than November 1, 2003. Any taps not so confirmed by November
1, 2003 will no longer be reserved. The reserved taps that are so
confirmed can be installed anytime as requested by the property
owner in accordance with the policies and procedures of the
District. The property owner will begin paying the District’s user
fees and charges upon the installation of taps in accordance with
the policies and procedures of the District. Effective May 1, 2004,
the property owner will begin paying the monthly availability fee
for all taps reserved, but not installed. Non-payment of the monthly
availability fee for reserved taps in accordance with the policies
and procedures of the District will result in permanent forfeiture
of the respective tap with the previously paid tap fee and monthly
availability fees retained by the District.
Exhibit B - A written notice will be provided by certified
mail to each property owner listed advising that the taps can be
installed anytime as requested by the property owner in accordance
with the policies and procedures of the District. The property owner
will begin paying the District’s user fees and charges upon the
installation of taps in accordance with the policies and procedures
of the District. Non-payment of the monthly availability fee for
reserved taps in accordance with the policies and procedures of the
District will result in permanent forfeiture of the respective tap
with the previously paid tap fees and monthly availability fees
retained by the District.
Exhibit C – A written notice will be provided by certified
mail to each property owner listed advising that the District must
receive a written request for the number of taps to be reserved,
with such request accompanied by payment of the associated tap fees,
and any other administrative information that the District may
require. Such reservation request must be provided by the property
owner to the District in writing no later than November 1, 2003. Any
taps not so confirmed by November 1, 2003 will not be reserved. The
reserved taps can be installed as requested by the property owner in
accordance with the policies and procedures of the District after
May 1, 2004. Effective May 1, 2004, the property owner will begin
paying the monthly availability fee for all taps reserved.
Non-payment of the monthly availability fee for reserved taps in
accordance with the policies and procedures of the District will
result in permanent forfeiture of the respective tap with the
previously paid tap fee and monthly availability fees retained by
the District. All reserved taps will be secured until April 30,
2005. All rights to reserved taps not installed by April 30, 2005
will be reviewed by the District for possible extension of the
reservation in accordance with the policies and procedures of the
District.
